TERMS OF USE POLICY

Registration

  1. To register for use with the TUC you must
    • Be enrolled in tertiary studies with a university, enrolled in other approved education with an RTO or a course approved by the TUC
    • Complete the application form and submit to TUC staff.
  2. Once processed applicants will be invited in for an interview with the Student Development Coach to complete an orientation and determine registration.
  3. Student registrations will be active until the end of a registration term in line with the TUC semesters: January – June and July to December. Students may renew their registration for a further term of 6months, provided that they continue to be enrolled in a course of study at a university or a course approved by the TUC.
  4. If students decide that the TUC is not for them, they may withdraw their registration within 10days of completing the registration form.
  5. During the term of the registration, the TUC will provide students with access to and use of the TUC resources, subject to these Terms of Use.
  6. At the end of the student’s initial registration term, and if they do not extend their existing registration, they must return any CUC property to the TUC.

 

Student Obligations

  1. While using the TUC, students must comply with:
    • These Terms of Use
    • The Network Use Policy
    • The Fob Use Policy
    • The Privacy Collection Policy
  2. While using the TUC resources, students must:
    • Take reasonable care for their own health and safety,
    • Take reasonable care to ensure that they do not adversely affect the health and safety of others,
    • Comply, so far as they are reasonably able, with any reasonable instruction of the TUC, and
    • Report any safety hazards they may become aware of to the TUC staff.
  3. Students must observe the following standards of behaviour while using TUC resources or in dealing with TUC staff and other TUC users:
    • Comply with all lawful and reasonable directions policies and procedures of the TUC
    • Refrain from any conduct that may cause any reasonable person unwanted offence, annoyance, or embarrassment,
    • Respect TUC resources by protecting them and using them responsibly.

Disclaimer

  1. Continuity and connection speed of internet access depends on a wide range of factors, many of which are beyond the control of the TUC. Consequently, the TUC accepts no liability for any disruptions to internet access.
  2. The TUC accepts no responsibility for any damage to or loss of data, hardware or software arising directly or indirectly from use of TUC resources, or their fitness for any particular purpose.

 

Termination

  1. If The TUC considers that a student is in breach of these Terms of USE, the Network Use Policy or the Swipe Card (FOB) Policy, they may either give the student a written warning or terminate their registration immediately.
  2. If they do not respond to the written warning within 14days, the TUC may terminate this agreement by giving them written notice.
  3. The TUC will consider the student’s response to the written warning and will either:
    • Resolve the written warning
    • Allow the student to continue to use the TUC resources subject to conditions, or
    • Terminate this agreement by giving them notice in writing.
  4. If the TUC has issued a student a written warning in the past and considers that they have committed a further breach of these policies, the TUC may terminate this agreement by giving them notice in writing.

PRIVACY COLLECTION POLICY

Purpose

TUC privacy collection policy sets out TUC’s responsibility on the collection, utilisation, and disclosure of personal information consistent with the Privacy Act 1988 and the Australian Privacy Principles found in that Act. Personal information is information or an opinion about an identified individual, or an individual who is reasonably identifiable.

The TUC collects, holds, uses and discloses personal information from students to carry out its programs and activities.

 

Policy Statement

The TUC is committed to respecting your privacy and complying with all of our privacy obligations under the Privacy Act 1988 and the Australian Privacy Principles. We are collecting your personal information submitted as part of your registration to access and use the TUC. This includes personal information such as:

  • Your name, address, phone number, email address,
  • Emergency contacts,
  • USI number.

TUC may also collect sensitive information about an individual with your consent in order to comply with our obligations under Australian Law, including but not limited to:

  • Language or cultural background,
  • Citizenship status,
  • Status as an Indigenous Australian,
  • Disability status, and
  • Health information.

TUC collects this information to assist us to correspond with you, to facilitate you receiving appropriate assistance in the event of an emergency, for Quality Assurance purposes and planning purposes. To promote the TUC in the media and with stakeholders, and to comply with relevant legislative reporting requirements. TUC will attempt to collect personal information directly from you wherever possible. In some cases, information may be collected from a third party, if this happens, we will take reasonable steps to ensure that you are aware that your personal information has been provided to us and of the matters contained in this policy statement.

Any personal information collected, stored, used, and disclosed by us will be treated in accordance with the Privacy Act and our Privacy Policy.

NETWORK USE POLICY

Purpose

TUC network use policy describes the acceptable use of the TUC network provided at Vocational Partnerships Group Inc. Usage of TUC network by all users is, at all times subject to this policy.

Scope

This policy applies to all TUC users.

Authorised Use

The TUC provides access to our network for use associated with student’s studies. Incidental personal use within reasonable limits is also permitted, however students are not permitted to download, transmit or store unauthorised software, large files containing images, video games, music or accessing internet broadcasts of radio and television stations.

 

Prohibited Use

The following is prohibited on the TUC network:

  • Intentionally creating, transmitting, or storing:
      • Information that is designed or is likely to:
          • Damage the TUC’s reputation,
          • Be misleading or deceptive,
          • Result in Victimisation or harassment,
          • Lead to criminal penalty or civil liability,
          • Be reasonably found to be offensive, obscene, indecent, threatening, abusive or defamatory, or
          • Cause annoyance, inconvenience, or needless anxiety.
      • Offensive, obscene, or indecent images,
      • Junk or chain mail, or
      • A computer or virus or worm.
  • Interfering with anther TUC network user or violating their privacy,
  • Disrupting or illegally accessing computer systems, including TUC network and those external to it. (This includes deliberately bypassing network filtering and anti-virus systems,
  • Transmitting or receiving material in breach of copyright laws,
  • Using the network for unapproved commercial purposes (e.g the transmission of unsolicited commercial or advertising material),
  • Port scanning (the scanning of another machine to determine which services are running),
  • Using password capturing or network sniffer programs,
  • Installing misappropriated, or unlicensed software, and
  • Running of peer to peer file sharing systems.

 

TUC users must report breaches or suspected breaches of this Network Use Policy to TUC staff.

 

Monitoring

  • TUC collects statistical data regarding the operations of it’s electronic communications systems.
  • TUC monitors the use of electronic communications to ensure the ongoing availability, reliability and security of these systems, including to detect unauthorised usage and other problems.
  • TUC will monitor individual user communications only in the event of a suspected breach of this Network Usage Policy

 

Data

It is your responsibility to save your work and data using your own storage devices. The TUC accepts no liability for any lost or corrupted data.

SWIPE CARD (FOB) USE POLICY

Purpose

This policy describes the acceptable use of the swipe card (FOB) system provided by the TUC. Usage of the swipe card system is always subject to this policy.

 

Scope

This policy applies to all TUC staff and users of the swipe card system.

 

Authorised Use

  1. The TUC provides access to the centre for use associated with students studies
  2. At the end of the registration term and if the student does not extend their existing registration, they must return the FOB and any other TUC property to the centre.

 

FOB

The TUC may issue adult (over 17 years of age) students with a genuine need for afterhours access with a FOB to access the TUC building. Students must not allow anyone else to use the FOB or use a FOB that does not belong to them.

If the FOB is lost or stolen, students must report it to the TUC staff immediately. A replacement cost of $30 will be charged for a replacement FOB.

 

Entry Hours

  1. The TUC will be accessible to registered students with valid FOB’s from 5:00am – 10:00pm Monday to Sunday, or otherwise specified by the TUC.
  2. Access to the TUC is constantly monitored by CCTV and the FOB monitoring system. STUDENTS MUST NOT let other people use their FOB. If something happens in the centre, while our systems identify a student as using the centre, responsibility will fall to them.
  3. The centre will be closed completely with no swipe card access over the Christmas/New Year’s period. Students will be notified in writing of designated timeframes.

 

Prohibited Entry

Under no circumstances is the following permitted at the TUC:

  • Vaping, smoking, drugs, or alcohol,
  • Anti-Social behaviour
  • Unregistered Users
  • Pets (Including therapy pets), or
  • Children –the TUC is not set up to accommodate children or pets and in the interests of all users, children and pets are not permitted at the centre.

 

Monitoring

The TUC collects statistical data regarding TUC user’s movements. TUC monitors the use of FOB’s to ensure ongoing availability, reliability and security of these systems, including to detect unauthorised usage.
